SECTION 1: Agreement
By accessing or browsing the website anlytic.in or by engaging anlytic for any technology, advisory, or development services, you agree to be bound in full by these Terms of Service. If you disagree with any portion of these terms, you must immediately cease using this website and refrain from engaging our services.

- "You", "your", "client" refers to any individual, representative, business, or corporate entity accessing our website or utilizing our professional services.

Note on Engagements: While these general Terms of Service govern your use of our public website and general interactions, all active client service engagements are governed by a separate, bilateral Statement of Work (SOW), Service Agreement, or Project Contract signed by both parties prior to the commencement of any billable work.
SECTION 3: Website Use
We grant you a limited, non-exclusive, non-transferable license to access our website for informational and communication purposes under these conditions:
- You agree to use anlytic.in solely for lawful purposes and in compliance with all local, national, and international laws.
- You may not attempt to gain unauthorized access to our administrative servers, source code, hosting environments, or digital systems.
- You may not use the website to distribute malware, upload offensive or unlawful content, or transmit spam or unsolicited advertising.
- You may not scrape, frame, harvest, crawl, or reproduce any part of our website text, designs, assets, or interactive features without our prior written consent.
We reserve the absolute right, in our sole discretion, to restrict, block, or terminate access to this website or refuse service to any individual or business entity at any time, without prior warning or liability.
SECTION 4: Intellectual Property
The entire design system, layouts, custom code, typography, vector assets, and copywriting of anlytic.in are the sole proprietary property of anlytic, unless otherwise stated.
- Brand Assets: The name anlytic, the stylized wordmark, logo icons, and secondary visual devices are proprietary trademarks of anlytic. You may not use them in connection with any product or service without explicit, written licensing.
- Client Deliverables: All custom software, database schemas, copywriting, and design files produced specifically for a client under a signed agreement become the exclusive intellectual property of the client upon receipt of full, finalized payment, subject to the conditions laid out in the specific contract.
- Portfolio Rights: anlytic reserves the perpetual, royalty-free right to display anonymized mockups, screenshots, and descriptions of the final client deliverables in our portfolio and promotional materials, unless specifically restricted by a signed Non-Disclosure Agreement (NDA).
SECTION 5: Client Engagements
For prospective clients seeking custom engineering or digital campaigns, our standard operational policies apply:
- Contracts & Approvals: No development or design activities begin until a formal, written agreement or SOW is signed, and the designated setup deposit or initial invoice is paid and cleared.
- Scope & Variations: Any changes to project scope, additional feature requests, or modifications to target timelines must be formally documented and approved in writing. Verbal requests or instant messaging chats are not contractually binding.
- Client Responsibilities: anlytic is not liable for project delivery delays or performance bottlenecks arising from a client's failure to provide necessary assets, API credentials, content materials, clear feedback, or prompt invoice payments.
- Retainers & Packages: Unused hours in monthly support retainers or pre-paid development buckets do not roll over to subsequent months and are non-refundable, unless explicitly specified in your active contract.
SECTION 6: Payment
Financial transactions for consultancy and software delivery adhere to standard corporate accounting principles:
- Currency: All quotes, estimates, and invoices are denominated and payable in United States Dollars (USD), unless a different local currency is formally agreed upon in writing.
- Payment Terms: All invoices must be paid in full within the period stated on the invoice (our standard terms are seven to fourteen calendar days from invoice issue date).
- Late Payments: Overdue accounts may be subject to a late fee of 1.5% interest per month, calculated daily on the outstanding balance from the due date until paid in full.
- Suspension: We reserve the right to immediately pause all developmental environments, hosting services, marketing campaigns, and consulting hours if any invoice remains unpaid past its designated due date.
SECTION 7: Confidentiality
Mutual trust is the foundation of our business. Both parties agree to protect and maintain the absolute confidentiality of all proprietary business metrics, strategic plans, source code repositories, and user database structures:
- anlytic will not disclose, distribute, or sell your proprietary operational data, user lists, or internal processes to any third party without your prior, express written consent, except to secure, standard subprocessors (such as cloud hosting providers) necessary to execute our deliverables.
- You agree to keep confidential all proprietary pricing structures, technical estimates, development workflows, software architecture blueprints, and non-public strategies shared by anlytic.
SECTION 8: Warranties & Disclaimers
This website and all informational contents are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including warranties of uptime, completeness, or suitability for a particular purpose.
- Marketing & Growth Outcomes: While we utilize high-grade technical search techniques and certified marketing frameworks, we cannot and do not guarantee specific outcomes. Search engine algorithms (Google, Bing, etc.) and advertisement conversion costs fluctuate due to external market factors out of our control.
- Case Studies & Benchmarks: All case studies, client reviews, and performance figures presented on our site are real, verified historical results. However, they represent indicative benchmarks and do not constitute a guarantee of identical outcomes for other businesses.
- Professional standard: We do warrant that all services delivered under signed agreements will be executed in a highly professional, expert manner by qualified engineers and strategists, in line with modern industry practices.
SECTION 9: Limitation of Liability
To the maximum extent permitted by applicable law:
- Cap on Liability: anlytic's total aggregate liability for any claims, actions, damages, or losses arising under these terms, our website, or any related service shall be strictly limited to the actual amount paid by the client to anlytic for the specific service giving rise to the claim during the three (3) months preceding the event.
- Exclusion of Damages: Under no circumstances shall anlytic or its founder, Anush Sharma, be liable for any indirect, special, incidental, punitive, or consequential damages, including loss of profits, system downtime, business interruption, data loss, or server breaches.
- Third-Party Outages: We accept no liability for losses caused by the failure or outage of external third-party software, cloud infrastructure (AWS, Vercel, GCP), or search engine algorithm updates.
SECTION 10: Indemnification
You agree to defend, indemnify, and hold harmless anlytic, its founder, contractors, and affiliates from and against any claims, losses, damages, liabilities, costs, and legal fees arising out of:
- Your misuse of our website or delivered services.
- Any intellectual property infringement or copyright violation in connection with assets, content, designs, or API access codes provided by you for our development use.
- Your violation of these Terms of Service or any applicable local laws.
SECTION 11: Termination
General terms regarding website access remain in effect as long as you visit our digital portals. For contract engagements:
- Either party may terminate an active project engagement with written notice in accordance with the specific termination protocols detailed in our signed bilateral contract.
- anlytic reserves the right to immediately terminate any engagement, block access, and revoke software licenses if the client breaches these terms, engages in fraudulent or illegal conduct, or fails to settle invoices past thirty (30) days.
SECTION 12: Governing Law & Disputes
These Terms of Service and any contractual relationships arising from them shall be governed, interpreted, and enforced in accordance with the laws of India, without regard to conflicts of law principles.
- Amicable Resolution: In the event of any disagreement or dispute, both parties agree to first engage in good-faith negotiations to achieve an amicable resolution for a minimum period of thirty (30) days.
- Arbitration: If unresolved through negotiation, all disputes shall be submitted to binding arbitration in Jaipur, Rajasthan, India, under the provisions of the Arbitration and Conciliation Act, 1996, by a sole arbitrator mutually selected by both parties. The language of arbitration shall be English, and the venue of proceedings shall be Jaipur.
- Global Clients: While governing law is centered in India, we hold deep respect for our international clients in the United States, Canada, United Kingdom, and Australia. We are committed to complying with all consumer protection regulations in your local jurisdictions and will always prioritize fair, professional business solutions.
SECTION 13: Changes to Terms
We reserve the right to modify these Terms of Service at any time. When updates are published, we will adjust the "Last Updated" date at the top of this document. Material changes will take effect fourteen (14) days after posting. Your continued use of anlytic.in or our services following the posting of changes constitutes your binding acceptance of the updated terms.
